NOTIFICATION OF FOOD SUPPLEMENTS IN ANDALUSIA

Does your company have its registered office in Andalusia and do you want to market food supplements? Keep reading because this post is of your interest.

As we have already told you in other posts that we have shared, when a company wants to dedicate itself to the distribution of food supplements in Spain, the first requirement that must be met is that the company responsible for the product is registered in the Spanish General Health Registry of Food Companies and Food (RGSEAA hereinafter).


Once the responsible operator has processed the registration with the RGSEAA, they can proceed with the notification of food supplements in Spain, without having to wait for the RGSEAA to assign their Registration number. Although the registration resolution procedure in the RGSEAA usually lasts approximately 3 months, from the moment the registration request is made, the requesting operator can now notify the placing of food supplements on the national market, which benefits largely to companies that do not have to wait during those months to be able to sell their food supplements in national territory (Andalusia, Madrid, Catalonia, Valencian Community, Murcia, Canary Islands, Asturias, Castilla y León, Castilla la Mancha, etc.).

In the case of Andalusia, those companies that have their registered office in an Andalusian province must process the notification of placing food supplements on the market before the corresponding Health Authorities of Andalusia according to the Province where their registered office is located.


The first thing that the responsible operator must take into account is that the label of their product complies with the applicable health regulations and mainly with the provisions of Regulation (EU) 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers; in Regulation (EC) 1924/2006 of the European Parliament and of the Council of 20 December 2006 on nutrition and health claims made on foods and in Spanish Royal Decree 1487/2009, of September 26, relating to Food Supplements.


In addition, the provisions of the applicable health regulations regarding the composition of the product must also be respected, highlighting the Commision Implementing Regulation (EU)  2017/2470 of 20 December 2017 establishing the Union list of novel foods; Commission Regulation (EU) 2022/2340 of 30 November 2022 amending Annex III to Regulation (EC) 1925/2006 of the European Parliament and of the Council as regards green tea extracts containing (-)-epigallocatechin-3-gallate (EGCG); Directive 2002/46/EC of the European Parliament and of the Council of 10 June 2002 on vitamins and minerals and Regulation (EC) 1925/2006 of the European Parliament and of the Council of 20 December 2006 on the addition of vitamins, minerals and of certain other substances to foods, among others.


Once the labeling of food supplements complies with the applicable health regulations, the notification procedure for food supplements in Andalusia must begin. To do this, you must complete the notification form provided by the Administration, send a copy of the label of the food supplement whose placing on the market is to be notified, and pay the administrative fee required by the Autonomous Community of Andalusia.

Regarding the fee for notification of food supplements in Andalusia, it is included in section 2.2 of fee 17.01 for Health Services, of Annex VI of Law 4/1988 of July 5 on public fees and prices of the Autonomous Community of Andalusia. The amount is 101.38 euros for each food supplement that is to be notified. This amount is reduced by 10% if the payment of the fee is made through electronic means, so the final amount is 91.24 euros per product.
